1. About these terms
SorkoPiko ("we") runs the Beatline levels website and the game's online features ("the service"). By using the service you agree to these terms.
2. Who can use it
You must be at least 13 and allowed to hold a Steam account. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
3. Your account
- You sign in with Steam. Each Steam account has one account here.
- Keep your sign-in secure. You are responsible for what happens under your account.
- A ban on an account can also apply to accounts that use the same copy of the game through Steam Family Sharing.
- You can erase your account from your account page.
4. What you must not do
- Upload anything illegal, hateful, harassing, sexually explicit, or that endangers or exploits children.
- Upload a level, song or name you have no right to share.
- Cheat on leaderboards, for example by sending runs a person did not play.
- Overload the service, scrape it, or try to get into what is not yours.
- Spread malware or spam.
- Download levels or songs to use outside the game.
5. Levels you upload
You keep ownership of your level. You give us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to host, copy, modify, show, distribute and use it, including in marketing. This continues after you delete the level or your account.
You also give everyone a licence to play your level, and to record, stream and publish videos, screenshots and other gameplay content of it, including for money.
You promise not to make copyright claims, takedown requests or content-ID claims against gameplay content of your level.
You consent, under Australian moral rights law, to acts that might otherwise infringe your moral rights in the level, such as editing it, not crediting you, or featuring it.
Songs are separate. This section covers your level, not music you do not own, and players need their own rights for any music in their videos. You give us a licence to host and play a song you upload while it stays on the service, and to show your runs and their replays to other players.
When you upload, you promise that you made the level, or have every right to share it, and that it does not infringe anyone's rights.
6. Copyright
We expect uploaders to respect copyright. A rights holder, or someone acting for one, can send us a notice with the form on our takedown page or by email to [email protected]. We also accept notices in other common formats, including DMCA-style notices.
- When a notice is valid, we promptly remove the song's audio from the levels it names and from other levels that use the same file. The levels stay up and play with the click track.
- We tell the uploaders what was claimed and who claimed it (the claimant's name or organisation). Each uploader gets a strike.
- An uploader can dispute a notice by sending us a statement within 30 days. Our staff decide whether to restore the audio. We may ask the claimant to respond.
- If a claim is withdrawn, we restore the audio and clear the strikes it caused.
- If nobody disputes a notice within 30 days, the takedown is final and we delete the song.
- Strikes expire after 12 months. An account with three active strikes is banned. We may ban sooner for serious or deliberate infringement.
Do not send a notice you know is false. A false notice can have legal consequences.
7. Reporting harmful content
Report a level in the game, or write to [email protected]. We review reports and remove content that breaks these terms or the law. We act on removal notices from Australia's eSafety Commissioner within 24 hours.
If you are in the European Union, this address is also our contact point under the Digital Services Act, for you and for authorities. When we remove content or restrict an account, we tell you why and how to contest it.
8. Removing content and accounts
We may remove or hide any level, song, run or name, refuse an upload, and suspend or ban an account when it breaks these terms or the law, or when a rights holder, court or authority requires it. Where we can, we tell you why. You can reply to us at [email protected], and we will review our decision.
9. Changes to the service
We may change, suspend or end the service or any part of it. Leaderboards can change when runs are removed or when levels or game versions change.
10. No warranty, and limits of liability
Our service comes with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have by law that cannot be excluded.
Apart from that, we provide the service as it is. We do not promise that it will always be available or free of errors, or that content from other players is safe, accurate or lawful. To the extent the law allows, we are not liable for indirect or consequential loss, for loss of data, or for content uploaded by others. Also to that extent, our total liability to you for anything to do with the service is limited to the greater of A$100 and what you paid us for the service in the last 12 months.
11. Changes to these terms
We may change these terms. The new version is posted here with its date, and applies from then. For significant changes we tell players in advance where we can. If you keep using the service after a change, you accept it.
12. Governing law
These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales can hear disputes about them. If you are a consumer, the mandatory consumer protection laws of your own country still apply to you.
